Truly Legal Music

Beware of music download web sites that make claims of being legal. You may find wording like this: "People are not getting sued for using our software". That is in fact is true. Use of the file sharing software is not illegal, nor is the program itself... but sharing mp3 music (the act of downloading mp3 music from other user without paying royalty fees to the artist) is NOT legal.

The act of downloading music without paying for it is what people in the US are being sued over. Even if you paid to be part of the file sharing program, none of that money goes to the artist.
Because so many file sharing programs claim to be legal, they are in fact deceiving the public by making it sound like the act of downloading mp3 music from their site is in fact legal. For this very reason, we do not try to over use the word legal.

We prefer to use the word "legitimate" because it's a word that has not been overused. Legitimate means that every site featured in our review has agreements in place to pay royalties to artists and record companies. The down side to this is that most of these sites are only available to residents of the United States. Some sites offer music downloads to multiple countries and we've tried to point that out where we can.

More on that in a moment, but first a brief explanation of the technology.

To “file share” is to be part of a network of computers connected through the internet. Usually is it a single folder on a users computer containing music in the form of Mp3's. The user installs the program and searches for a particular piece of music. What are Legal Music Downloads?

A few years ago, US record companies decided to challenge file sharing in the courts. First, they went after the biggest file sharing network at the time: Napster. There main purpose was to shut it down which they succeeded at doing, but the precedence was set. File sharing was soon to become illegal even by individuals.

The record companies had a bit of a set back a couple of years later. The technology which allowed file sharing was stated to be legal, only the act of individuals sharing music files was illegal. Therefore, record companies began to go after individuals to set a precedence that if you download music from a file sharing system, you are breaking the law.

Then Napster had an idea. They thought "let's work together with the record companies to provide music for listeners at a cost, then pass part of the earnings on to individual artists". Legal music downloading was born. Today there are several sites like Napster including eMusic.com, MusicNet, Real Rhapsody, MSN Music, Musicnow, iTunes, Sony-Connect, Buy.com, Walmart, Virgin-Digital, PureTracks, and MSN Music. So, to answer the question "what makes legal music download sites different than file sharing networks?", artists get paid out of the gingival songs you purchase. What's a legal music download?

Beware of web sites that make claims of being legal. You may find wording like this: "People are not getting sued for using our software". That is in fact is true. Use of the file sharing software is not illegal... but sharing mp3 music (the act of downloading the music without paying royalty fees to the artist) is NOT legal. That act of downloading music without paying for it is what people in the US are being sued over.

Even if you paid to be part of the file sharing program, none of that money goes to the artist.
Because so many file sharing programs claim to be legal, they are in fact deceiving the public by making it sound like the act of downloading mp3 music from their site is also legal.

Some mp3 review sites feature only software that promotes illegal file sharing. Many review sites feature a mix of standard file sharing programs and legitimate "truly legal" music download sites such as Napster, iTunes, Real Rhapsody and emusic. There is however one site that features only legal downloads. The negative side of this is that a lot of these programs only have agreements with record companies in the US.
